Terms of Service

These terms provide clear rules for development, hosting, Minecraft servers, VPS, SaaS, support, and maintenance services.

1. Scope and contracting party

These Terms of Service apply to contracts between Xeno Development, jointly managed by Marius Lutz Wözel (Founder & CEO) and Joschua Czock (Co-Founder & COO), and the customer for digital services, development, SaaS, hosting, Minecraft servers, VPS servers, support, and maintenance. Individual agreements, quotes, and service descriptions take precedence over these terms.

2. Contract formation and consumer rights

Presentations on the website are non-binding. A contract is formed by written confirmation, invoicing, or commencement of the agreed service. Statutory information and withdrawal rights of consumers remain unaffected; performance before the end of a withdrawal period begins only where the statutory requirements are met.

3. Scope of services

The exact scope follows from the applicable quote, package, contract, or product description. Services may include website and bot development, hosting, Minecraft and VPS servers, Kitsune or other SaaS systems, individual digital services, support, maintenance, and updates. Extensions not expressly agreed are quoted separately.

4. Customer cooperation duties

The customer provides required content, information, approvals, and access in a timely manner and suitable quality. Contact and contract data must be correct and current, and relevant changes, security issues, or abuse must be reported promptly. Delays caused by missing cooperation extend agreed deadlines appropriately.

5. Credentials and system security

Credentials must be kept confidential, protected with strong passwords, and not shared without authorization. The customer is responsible for security updates to their own systems, CMS, plugins, bots, applications, and self-managed servers. Suspected unauthorized access must be reported to Xeno Development immediately.

6. Development, acceptance, and changes

For development services, the customer is given an opportunity to review and accept the work. Defects must be described reproducibly. Later functional, design, or content changes outside the agreed scope may be charged separately. Delivery estimates are binding only when expressly agreed as fixed dates.

7. Usage rights, SaaS, and source-code buyout

Usage rights follow the individual agreement. Managed hosting or SaaS generally grants a right of use limited to the contract term; source code and internal system structures remain with Xeno Development. A source-code buyout and its scope must be expressly agreed and fully paid. Mandatory statutory rights remain unaffected.

8. Support, maintenance, and updates

Support and maintenance follow the selected package. Defects within Xeno Development’s responsibility are handled within the agreed scope. New features, post-acceptance changes, work on third-party software, and services outside the package may be charged separately. Response or resolution times are binding only if expressly agreed.

9. Hosting and availability

Xeno Development strives for stable and secure operation but does not guarantee 100% availability. Maintenance, technical incidents, attacks, data-center or provider outages, force majeure, and events beyond direct control may cause interruptions. Short interruptions do not automatically create a right to refunds or damages.

10. Maintenance windows and emergency measures

Planned maintenance is announced in advance where possible. Security-critical updates, emergency maintenance, and stabilization or protective measures may be performed without prior notice. Xeno Development may temporarily restrict affected services where necessary to protect infrastructure or other customers.

11. Backups and restoration

The customer remains responsible for their own current, externally stored backups. Xeno Development generally creates one automated backup per day, usually around 05:00 a.m.; no specific time, complete backup, or successful restoration at all times is guaranteed. Backups are an additional safeguard and do not replace the customer’s own backup duty. The customer must create a backup before major changes, updates, installations, or deletions.

12. Minecraft servers and game data

The customer is responsible for worlds, plugins, mods, configurations, players, and provided content. Faulty or incompatible plugins, mods, scripts, or settings may cause data loss, crashes, and performance issues. Xeno Development is liable for resulting damage only to the extent required by law. Worlds, plugins, configurations, and player data must be backed up regularly.

13. VPS servers and self-management

For VPS servers, the customer is fully responsible for stored data, services, applications, configurations, security measures, and backups unless a separate managed service is agreed. Systems must be kept current, access secured, and use must comply with laws, third-party rights, and applicable provider rules.

14. Prohibited VPS use and abuse

Prohibited activities include spam, phishing, malware, botnets, DDoS tools, port scans against third-party systems, brute-force attacks, crypto mining without express permission, illegal downloads, copyright-infringing content, fraudulent sites, fake shops, extremist or other criminal content, and any use violating laws, third-party rights, or provider rules.

15. Minecraft server rules

Minecraft servers may not host unlawful content or content violating third-party rights or applicable platform rules. Excessive load, exploits, bot attacks, and abusive use are prohibited. The customer is responsible for users, administrators, plugins, mods, and server content.

16. Resources and fair use

CPU, RAM, storage, network, databases, and other resources may be used only within the agreed scope. Sustained overload or use affecting other customers, servers, or infrastructure may result in temporary limits, technical adjustments, suspension, or termination in the event of repeated abuse.

17. Third parties, APIs, and external services

Services may depend on data centers, network operators, domain providers, Discord, payment providers, or other external services. Changes, restrictions, or outages may affect functionality. Adjustments required by changed APIs or third-party systems are included only if expressly agreed.

18. Prices, prepayment, and billing

Prices and billing periods follow the quote, product description, or contract. Services and hosting products may be billed in advance. Recurring services are payable on their respective due date. Activation or renewal may depend on confirmed receipt of payment.

19. Late payment, suspension, and reactivation

If payment is not made on time, Xeno Development may, after appropriate review, suspend or restrict the service and terminate it after a reasonable period. Because infrastructure costs continue, there is no right to permanent service without payment. Reactivation after full payment may be possible if data still exists and remains technically usable.

20. Suspension for abuse

For serious or urgent violations, specific security threats, unlawful use, or harm to third parties, Xeno Development may immediately and temporarily suspend or restrict services. Permanent termination may follow after review. Statutory rights and necessary protective measures remain unaffected.

21. Contract end and data deletion

After termination or contract end, customer data may be deleted following a reasonable period. The customer must create timely backups and exports. Restoration after deletion is not guaranteed. Immediate suspension may be required for abuse, security threats, or legal reasons.

22. Term and cancellation

The term and cancellation period follow the applicable contract or product. Unless otherwise agreed, hosting products may be canceled at the end of the already paid period. Started and paid service periods are refunded only where required by law or expressly agreed.

23. Customer content and data protection

The customer is responsible for the lawfulness of their content and personal data processing. Where Xeno Development processes personal data on the customer’s behalf as part of hosting services, a data processing agreement may additionally be concluded. The customer remains responsible for the purposes and lawfulness of their processing.

24. Liability

Xeno Development is liable without limitation for intent, gross negligence, and injury to life, body, or health. For slight negligence involving a material contractual duty, liability is limited to foreseeable damage typical for the contract. Mandatory statutory liability remains unaffected.

25. Customer systems, third-party software, and external events

For damage primarily caused by customer systems, customer content, self-installed software, plugins, mods, misconfiguration, or external providers, Xeno Development is liable only to the extent required by law. The same applies to outages caused by force majeure, DDoS attacks, provider incidents, maintenance, or events outside direct control.

26. Defects and warranty

Statutory defect rights remain in place. The customer must report identifiable defects promptly and reproducibly and provide a reasonable opportunity for investigation and cure. Warranty claims may cease to apply where a defect was caused by unauthorized changes, third-party software, or improper use.

27. Authorities, providers, and preservation of evidence

Xeno Development may cooperate with authorities, data centers, providers, and affected third parties to the extent legally permitted and necessary. Data may be temporarily preserved where required for contract performance, threat prevention, preservation of evidence, or compliance with legal duties.

28. Final provisions

The law of the Federal Republic of Germany applies, subject to mandatory consumer protection provisions. A place of jurisdiction is agreed only where legally permitted. If individual provisions are invalid, the remaining provisions remain unaffected.
